These Terms of Service ("Terms") govern your access to and use of the Newsletr platform ("Service"), operated by Peak8 Advisors ("we," "us," or "our"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
Newsletr is a multi-tenant newsletter platform that generates and delivers AI-curated content briefings to your subscribers. We provide the software, infrastructure, and tooling. You are the operator of your newsletter and are solely responsible for your subscriber relationships, content decisions, and compliance with applicable laws.
Access to Newsletr requires a paid subscription. Subscriptions are billed monthly in advance on the same date each billing cycle. You authorize us to charge your payment method on a recurring basis until you cancel. All fees are stated in US dollars and are exclusive of any applicable taxes, which are your responsibility.
You may cancel your subscription at any time. To avoid being charged for the next billing period, you must cancel before your renewal date. Cancellation takes effect at the end of your current paid period. See our Cancellation Policy for full details.
All fees are non-refundable except in limited circumstances at our sole discretion. We do not issue refunds for partial months, unused periods, or billing cycles where you failed to cancel in time. See our Refund Policy for full details.

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.
You are the data controller for your subscribers' personal information. We process that data on your behalf as a data processor. You are responsible for obtaining lawful consent from subscribers, maintaining a compliant privacy policy, and honoring unsubscribe and deletion requests. We will not sell or share your subscriber data with third parties except as required to deliver the Service.
Content delivered through the platform is AI-generated based on publicly available sources. We do not guarantee the accuracy, completeness, or timeliness of any content. You are responsible for reviewing content before it is sent to subscribers. We disclaim all liability for errors or omissions in AI-generated material.
We aim for high availability but do not guarantee uninterrupted or error-free service. Scheduled maintenance, infrastructure events, or third-party outages may cause temporary unavailability. We are not liable for downtime, missed sends, or loss of data resulting from service interruptions.
We own all rights to the Newsletr platform, software, and underlying systems. You retain ownership of your newsletter brand, custom content, and subscriber relationships. By using the Service you grant us a limited license to process and transmit your content and subscriber data solely to operate and improve the Service.
To the maximum extent permitted by law, our total liability to you for any claim arising from or related to these Terms or the Service is limited to the fees you paid in the 30 days preceding the claim. In no event are we liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost data.
You agree to indemnify and hold harmless Peak8 Advisors and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your newsletters, your subscriber relationships, or your violation of these Terms.
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in your admin dashboard. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of New York County, New York.
